Minutes of the Iron County Commission Meeting held November 12, 1996 in Commission Chambers at the Iron County Courthouse, Parowan, Utah. Convened at 9:00 A.M.

MINUTES :

Minutes of the Iron County Commission Meeting held October 28, 1996 were approved as amended on a motion by Roy Urie, second by Tom Cardon and Robert Gardner voted in favor.

CEDAR CITY TV SITE PURCHASE :

Commissioner Urie reported that as the new site was being prepared for the TV Translator system for Cedar City, it was found that the best place to install the receive antennas was located on the parcel of land north of the existing site. In conversations with the owner, John Kelly, it was determined that it would be an advantage for Iron County to purchase an additional 20 acres.

Mr. Urie made a motion to authorize the purchase of an additional 20 acres from the Kelly family for the purpose of improving a TV Translator site in Cedar City. Second was by Tom Cardon and Robert Gardner voted in favor.

ECONOMIC DEVELOPMENT SUMMIT :

An Economic Development Summit will be held in Cedar City at Southern Utah University on November 21, 1996. Commissioners Urie and Cardon will attend the conference.

WESTERN STATES COALITION :

Roy Urie reported that the County has received a request for $100.00 to help defray the costs of the Western States Coalition Summit scheduled for November 13 and 14, 1996. Commissioner Urie made a motion to fund the request provided that the funds specifically not be used to help fund a lawsuit being pursued by Western States Coalition against the Bureau of Land Management. Second was by Tom Cardon with Robert Gardner voting in favor.

SENIOR CITIZEN CENTER, CEDAR CITY :

Commissioner Urie reported that there was a plug in the sewer line at the Cedar City Senior Citizen Center. It appears that the plug may be related to recent construction at the Center. Commissioner Urie was authorized to contact Jones Plumbing to repair the problem.

COX PROPERTY SALE :

Commissioner Cardon reported that the bid for the sale of the Cox property to Eagle Pointe Financial Group had been withdrawn. Commissioner Cardon also reported that Kerry Smith, one of the original firms submitting a bid was still interested in purchasing the site and they were willing to pay $400,000.00.

Because they were one of the original bidders, Commissioner Cardon made a motion to accept their offer. Second was by Roy Urie and Robert Gardner voted in favor. Justin Wayment was asked to coordinate the purchase agreement with the purchasers.

UTAH SUMMER GAMES :

David Slack, Summer Games Coordinator presented a plaque to the County for their support of the Summer Games. He then reported on the success the games have experienced during the past two years. He said that the majority of the athletes participating are from the Wasatch front counties which brings them and their families to Iron County.

Mr. Slack requested a twenty percent (20%) increase in funding above the $25,000 donated in 1996 for the 1997 year. The Commission took the request under advisement and it will be considered in the budget process.

LANDFILL POWER LINE :

Alan Wade reported to the Commission that Utah Power estimated the cost to upgrade power service to the Landfill would be $32,760. This would eliminate safety hazards with the current lines and transformers. Alan also reported that Frank Nichols, the owner of land currently serviced by the line was not interested in participating in upgrading the lines.

Alan also reported that he had received an estimate of costs to upgrade the service within the shop. The estimate was $9,787.

The matter was taken under advisement to allow time for further study on the power needs and upgrades at the landfill.

TAX MATTERS :

Mary Sullivan. Dennis Ayers reported that an error had been made in property owned by Mary Sullivan identified as Serial # E-1085-5-2. The property was assessed as a secondary residence when it should have been a primary residence. This was corrected on the 1996 tax rolls. Ms. Sullivan was requesting a refund of taxes paid in error for tax years 1991 to 1995.

Commissioner Urie made a motion to refund the taxes paid in error as requested. Second was by Tom Cardon with Robert Gardner voting in favor.

AMPAC. Dennis also reported on negotiations with AMPAC regarding WECCO and the Azide properties. He said that an agreement had been reached on the values for these portions of the facility. There are still questions on the Halatron portion of the property and the method to be used in assessing the tax.

Dennis reported that representatives from AMPAC would attend the November 25 Commission meeting to see if an agreement can be reached.

1997 BOOKMOBILE CONTRACT :

A contract for bookmobile services for 1997 was approved on a motion by Roy Urie, second by Tom Cardon with Robert Gardner voting in favor and signing the contract. The contract is for $39,677.

GENERAL ELECTION CANVASS OF BALLOTS :

At 12:00 Noon, as required by state law, the County Commission canvassed the election returns for the General Election held November 5, 1996. David Yardley reported that he had received a fax from the State Democratic Party expressing concerns with the ballots that were used and the possibility that the ballots were not punched properly. David explained to the Commission that on election night, election workers had inspected each ballot and that the problems experienced in Salt Lake County were not found in Iron County ballot cards.

After all of the absentee ballots were counted and added to the election night totals, Tom Cardon made a motion to accepting the election results as final. Second was by Roy Urie and Commissioner Gardner voted in favor.

A copy of election totals by precinct are hereby made a part of the minutes.

APPROVAL OF BILLS :

After the bills were reviewed and either approved or rejected, the meeting adjourned at 1:20 P.M.
