Minutes of the Iron County Commission Meeting held August 12, 1996, in Commission Chambers at the Iron County Courthouse, Parowan, Utah.

MINUTES :

Minutes of the Iron County Commission meeting held July 22, 1996 were approved as amended on a motion by Roy Urie, second by Tom Cardon and Robert Gardner voted in favor.

COMMISSION REPORTS :

Commissioner Urie discussed the planned improvements on the parking lot at the Cedar City Senior Citizen Center. The project will include surfacing the parking lot and improving storm drainage from the parking area. Commissioner Urie also explained that Cedar City owns a small parcel adjacent to the Northwest corner of the property. They have agreed that a portion of this parcel could be included as additional parking area. With the additional area the estimates for costs would need to be reviewed. The Commission felt that the additional area should be included in the project.

Commissioner Urie discussed a letter received from Olympus Insurance requesting that they be given an opportunity to review County liability insurance and compare their costs with the County insurance pool. The Commission decided that at the present time it is in the County's best interest at the present time to stay with the County Pool.

Sonny Richardson approached the Commission to request that Parowan City be allowed to remove gravel from the County pit at the Gap to gravel a small parking area at a proposed park on the Northeast corner of Center and Main street in Parowan and also to gravel an undeveloped road in Sunset View Subdivision. The Commission took the request under advisement and Commissioner Gardner was to coordinate and discuss the request with the Road Supervisor and Parowan City.

CONFERENCES: A conference on workforce management has been scheduled in Salt Lake City on September 20, 1996. Commissioner Urie will check and see if a representative from the County should be in attendance. He will attend if he needs too.

Commissioners Urie and Cardon will attend the Utah Rural Summit Conference scheduled at Southern Utah University on September 4 through 6. David Yardley was ask to make reservations.

Commissioners Cardon and Urie and Planning Commission Chairman Clint Neilsen will attend a conference on Ideas for Water Management Strategies to be held at Brian Head on October 2, 1996. David Yardley was ask to make reservations for the conference.

Commissioner Cardon discussed the management at the Cedar City dog pound. Cedar City is not providing animal control in the county at the present time. In discussions with Cedar City, they are willing to continue to accept animal from the county provided they are brought to the facility. They are also willing to help with vicious or other problem animals.

Justin Wayment was ask to research an animal control ordinance.

Commissioner Gardner reported that the Shirts Canyon bridge near Hamilton Fort on old Highway 91 is scheduled for funding a widening and improvement project in 1998. Commissioner Gardner will follow up with UDOT.

Commissioner Gardner also reported that Robert Weidner, a lobbyist in Washington D.C., had contacted him and requested support of a position taken by Emery County where they were going to file suit to block a proposal to re-open the wilderness appraisal process on BLM lands in Utah. This is a proposal that is being considered by Secretary of the Interior Bruce Babbitt.

MISS IRON COUNTY PAGEANT :

Teri Linford and Arlene Olcott representing the Miss Iron County Pageant came to request that Iron County continue to support the pageant by authorizing a contribution to the pageant of $425.00. Commissioner Cardon made a motion to authorize the requested donation from the Fair budget. Second was by Roy Urie with Robert Gardner voting in favor.

Teri also reported that there are sixteen participants in the pageant this year and the contest will be held in Cedar City at the High School Auditorium on August 29.

TIRE RECYCLING NU-CYCLE, L.L.C. :

Kurt Bunker, Devery Snow and Dexter Snow representing Nu-Cycle L.L.C. requested a conditional use permit for a tire recycling operation at the Hecla mine property. The operation they will be installing at this time will use pre shredded material which comes in compressed bales. They propose to manufacture shipping material such as palates and 4x4 posts.

They explained that the operation meets all federal and state air quality and emission standards. All of the by products are recyclable and will be sold.

Commissioner Cardon reported that the Planning Commission recommended approval provided that all appropriate State and Federal permits could be obtained and that an appropriate bond be posted and maintained with the County for a cleanup fee.

Commissioner Cardon made a motion to approve a conditional use permit for Nu-Cycle L.L.C. with the following conditions:

Post a bond for $25,000.00

Obtain appropriate State and Federal permits.

Obtain County business license.

Commissioner Urie seconded the motion and Commissioner Gardner voted in favor. David Yardley was ask to write a letter confirming the action taken by the Commission.

MIDVALLEY ESTATES ROADS :

Mike Kullman, president of Midvalley Estates Water Company and a land developer, came before the Commission to request that a Special Improvement Area (SIA) be established in Midvalley Estates to improve and oil the roads. Mr. Kullman said that there are now 110 of 270 lots that have residences on them.

The Commission referred Mr. Kullman to the County Attorney for advice on how to proceed with the process of establishing a SIA. He was also ask to contact Steve Platt so that he can start getting some preliminary cost figures.

MINOR LOT SUBDIVISION NORMAN GIRTON :

Norman and Patricia Girton requested approval of a minor lot subdivision in the Northeast 1/4 Northeast 1/4 of the Southeast 1/4 Section 15, Township 35 South, Range 11 West, Salt Lake Base and Meridian. Their property is currently in one ten acre parcel. They would like to divide it and make two five acre parcels.

Tom Cardon reported that the Planning Commission had recommended approval provided that Girton's furnish a plot plan showing access to both parcels. Commissioner Cardon then made a motion to approve the minor lot subdivision as presented pending submission and approval of a plot plan. Second was by Roy Urie and Robert Gardner voted in favor.

COMPUTER TRUST, DOUG WILSON :

Doug Wilson discussed the budgeting process that the Computer Trust has operated under in the past. The County's have budgeted $5,000 toward software development. This has been sufficient to fund programs in the past.

In 1996 the trust has recommended that the Recorder's develop a record system to store documents on disks. The Assessor's have recommended upgrades in their programs and the Treasurer's have recommended upgrades to their programs. Together the programs have been billed thus far in 1996 to Iron County $8,585. Doug recommended that each department budget for software development.

Roy Urie made a motion to authorize expenditure from each department with software development with the Computer Trust to cover their own program and to authorize each department in the future to include in their budget appropriate software development. Second was by Tom Cardon with Robert Gardner voting in favor.

STATE TAX COMMISSION :

Blaine Willis, Brent Eyre, David Swan, Steve Farrell, Clark Price and Mark Maxfield representing the State Tax Commission discussed the process for placing a taxable value on centrally assessed properties. This class of property is taxed at 100% of the fair market value and covers enterprises that cross county lines, mining properties, airlines, and utilities. In some cases such as rail roads, values are placed on the entire system and apportioned between the states served.

Personal property classification was also discussed, specifically in relationship to attaching mobile homes as improvements to real estate and the designation of equipment at the WECCO facility.

911 TRAINING VIDEO PURCHASE :

Linda Petty requested the County fund the purchase of a training video to be used in the schools for grades kindergarten through second. This video explains the purpose of 911 and what calls are appropriate for 911. In areas where this has been used, it has helped to cut the number of calls that do not require 911 assistance.

Roy Urie made a motion to approve the purchase of the 911 video. Second was by Tom Cardon and Robert Gardner voted in favor.

ONE STOP VISITOR CENTER PUBLIC HEARING :

A public hearing has been scheduled for August 22, 1996 in the Cedar City Council chambers between the hours of 7:00 P.M. and 9:00 P.M. to receive public comments on the proposed One Stop Visitor Center. Commissioner Tom Cardon was designated as the hearing officer. David Yardley was ask to publish a notice of the hearing.

SEWER ORDINANCE :

A proposed sewer ordinance for county residents which would be connected to the Cedar City Wastewater Treatment Facility was presented by Justin Wayment. The commission tabled the matter to allow time to review the proposed ordinance. This will be placed on the next agenda.

After the bills were reviewed and either approved or rejected, the meeting was adjourned.
