MINUTES :

Minutes of the Iron County Commission Meeting held on June 24, 1996 were approved as amended on a motion by Roy Urie, second by Tom Cardon and Robert Gardner voted in favor.

COMMISSION REPORTS :

Commissioner Urie reported that he had been receiving complaints from County residents about people storing trash on their property. These complaints should be followed up by the Sheriff's Department to see if they can be cited under the nuisance ordinance.

BAILIFF AGREEMENT: Commissioner Cardon reported that Ira Schoppmann had been in contact with the State Courts and had negotiated a new contract for Court Bailiff. Ira requested that the County approve a contract for $16.00 per hour for the period July 1, 1996 to June 30, 1997.

Tom Cardon made a motion to approve the Bailiff Contract as presented. Second was by Roy Urie. Robert Gardner voted in favor and he signed the agreement.

OLD IRON TOWN: Commissioner Urie reported that an application has been completed and is ready to submit to Geneva Steel for help in upgrading and preserving the Old Iron Town site. This should be submitted within the next two weeks.

CEDAR CITY ASSESSOR OFFICE INCIDENT: Tom Cardon reported on an incident at the Iron County Assessor's Office in Cedar City. A customer demanded that the deputies reduce the amount of tax on a motor vehicle. When they explained that they did not have authority to change tax amounts and also explained how to appeal the value, the customer became very belligerent. It became so bad that the Assessor's Deputies called 911 and requested police assistance.

Justin Wayment was asked to follow up on this incident to determine if charges should be filed for disorderly conduct.

BUILDING INSPECTOR CERTIFICATION: Commissioner Cardon reported that two of our building inspector's were taking certification tests this week. Ron Davis is taking the Building test and Terry Palmer is taking the State plumbing test.

STATE FIRE CONTROL AGREEMENT :

An agreement between Iron County and Utah State Lands and Forestry for fire suppression in Iron County was called again for discussion. After reviewing the agreement, there were some concerns remaining. The matter was tabled until the next meeting.

TAX MATTER-CEDAR CITY :

Joe Melling, Cedar City Manager, requested the taxes on a parcel of property which was deeded to Cedar City be exempted from taxes for the 1992 year. The property is located on the Southwest corner of Center and Main and is identified as tax serial number B-537 account number 54236. Mr. Melling explained that the previous owner, State Bank of Southern Utah was in the process of transferring title in October of 1991, however because of soil contamination problems the deed was not filed until 1992.

After looking at the deed which was filed in November of 1992, the Commission agreed to place the property in a tax exempt status on the date the deed was recorded, November 20, 1992. They further agreed to waive interest and penalty on the delinquent tax.

FLOOD CONTROL :

Steve Platt, County Engineer, discussed with the Commission flood control on Coal Creek. Steve questioned the split of flood water and the direction it was to be diverted. It was determined that the water should be split at the Woodbury split and to divert 1/3 to the Southwest and eventually to Quichapa Lake and 2/3 to be diverted North towards the old Stevensville townsite and beyond.

The estimates of a one hundred year flood range from 6,000 Cubic Feet per Second (CFS) by the Soil Conservation Service to 9,300 CFS estimated by the Army Corps of Engineers.

The flood plan is to be designed to go in the existing channel to 3000 North and then follow straight North past the Midvalley Road (4800 North) to the old Stevensville townsite.

PARAGONAH ROAD MAINTENANCE :

Trisha Robb, City Council representative from Paragonah requested the use of County equipment in seal coating the existing oil roads within Paragonah. The Commission explained that the County has participated with the Cities in such projects when the road equipment is not being used on County projects.

Typically the Road Department works on a schedule of four ten hour days so the equipment is available on Friday and Saturday. The Cities that are requesting the help are to pay the Road Department Personnel for the time they are used within the City.

EXECUTIVE SESSION-PERSONNEL :

Roy Urie made a motion to convene in executive session to discuss personnel matters and possible litigation. A settlement conference scheduled for July 26, 1996 in Cedar City was discussed.

No formal action was needed or taken at this time.

A & B PROPERTIES PROPOSAL :

William Hobson, Jim Webster and Alan Knox discussed with the Commission the possible development of a nine acre site near the South I-15 interchange in Cedar City. They are proposing that a portion of the site be developed as motel or hotel facility. They also requested that the County might consider participating in funding a convention center.

The Commission explained that at the present time, they are committed to the convention facility being constructed on the Southern Utah University campus. Until the County has some experience with conventions, and the need has been defined for an additional facility, there can be no commitment to participate in an additional convention center.

The Commission suggested that the property owners coordinate with LaRee Garfield and Brent Drew to determine the need and the probable use of a stand alone convention center. They also suggested that Cedar City may wish to participate in this type of venture.

BOOKMOBILE CONTRACT APPROVAL :

An agreement for Bookmobile service for 1996-97 was reviewed and approved on a motion by Roy Urie, Second by Tom Cardon and Commissioner Gardner voted in favor.

GARBAGE MATTER :

A request from Karen Frye for a waiver of their Solid Waste Collection bill was received and reviewed. Ms. Frye said they are moving to Ohio and would like to terminate the service until their home is sold.

The Commission declined to issue a waiver at this time. It has been the policy that all habitable homes that have the service provided are required to pay for the service.

After the bills were reviewed and either approved or rejected, the meeting was adjourned.
