Minutes of the Iron County Commission Meeting held January 8, 1996, in Commission Chambers at the Iron County Courthouse in Parowan, Utah.

APPOINTMENT OF COMMISSION CHAIRMAN:
Tom Cardon made a motion to appoint Robert Gardner as the Commission Chairman for 1996. Second was by Roy Urie with Robert Gardner voting in favor. At that time, Commissioner Urie passed the gavel to Commission Gardner and the meeting proceeded.
MINUTES :
Minutes from the meeting held December 28, 1995, were approved as amended on a motion by Roy Urie, second by Tom Cardon with Robert Gardner voting in favor.
COMMISSION REPORTS :
Commissioner Urie reported on the Western States Coalition meetings that he had attended in Portland Ore. He said that there were approximately 400 people in attendance at the conference and that there was a lot of good information obtained on wilderness, wild and scenic rivers and other federal land issues. The next Western States Coalition meeting is scheduled to be held in Casper Wyoming next spring. Commissioner Urie said that he was concerned that there was a lot of talk but not much action and it was becoming a forum to vent feelings.
Ambulance. Commissioner Urie reported that Cedar City was ready to take final action on the use permit to allow construction of an ambulance garage. The garage will be located on D.L. Sargent Drive and will face South. The proposed site is on the Southeast corner of the Iron County/Utah State Correction Facility property.
Board Appointment. Robert Gardner reported that Gayle Wood has resigned from the Weed Board. It has been proposed that Alan Adams be appointed to fill the unexpired term. Commissioner Cardon made a motion to appoint Alan Adams as proposed. Second was by Commissioner Urie with Commissioner Gardner voting in favor.
Liability insurance for chemical accidents while weed spraying was also discussed. Commissioner Gardner will follow up with discussions with the UAC Mutual to determine County insurance coverage and optional insurance availability for weed spraying.
Building Permits. Tom Cardon reported those building permits in Iron
County, Enoch and Paragonah for 1995 exceeded 15 million dollars in value which produced $237,839.00 to the County for building permit fees.
County Sales Tax. The Utah Association of Counties is proposing legislation in the 1996 Legislative session to allow a county sales tax. The amount generated from this tax would reduce the current property tax by 90%. The Commission was in support of the proposed tax which would allow for an additional income source to fund county services.
Commissioner Gardner was asked to arrange a meeting place with the mayors and city managers within the County to discuss this proposal and seek their support.
PURCHASE AGREEMENT CEDAR CITY TV SITE:
A purchase agreement for a new Cedar City TV site was reviewed and approved on a motion by Roy Urie, second by Tom Cardon with Robert Gardner voting in favor. The agreement was signed and is to be forwarded to John Kelly, the property owner for his signature.
SUMMIT SPECIAL SERVICE DISTRICT :
A request to reappoint Ralph Green, Delos Dalton and Deo Jones to a new four year terms on the Summit Special Service District Board was approved on a motion by Roy Urie, second by Tom Cardon with Robert Gardner voting in favor.
SUMMIT SPECIAL SERVICE DISTRICT :
A petition to expand the boundaries of the Summit Special Service District was discussed with Steven Burgs, an attorney representing the District and Roxanna Johnson, secretary of the Special Service District. It is their desire to add three parcels to the Service District. One parcel is not contiguous to the current boundaries. Current Utah Code allows for service to areas not connected to the boundaries and a precedent has been set in that the Cemetery parcel receives service under the current district boundaries.
After reviewing the proposed expansion, Tom Cardon made a motion to approve Iron County Resolution 96-1 to to approve a public hearing on the proposal to extend the boundaries of the Summit Special Service District. The public hearing on the proposed boundary amendment has been set at 10:00 A.M. on February 12, 1996. Second was by Roy Urie with Robert Gardner voting in favor.
PERSONNEL - EXECUTIVE SESSION :
Tom Cardon made a motion to convene in an executive session to discuss personnel items. Second was by Roy Urie with Robert Gardner voting in favor.
Several items were discussed which included items in the building inspector's department and senior citizens.
After reconvening in open session, Roy Urie made a motion to allow the County to extend COBRA health insurance for Emma Rasmussen's husband, Howard, for a period up to eighteen months. The Rasmussen's would be responsible for paying the premiums. Second was by Tom Cardon with Robert Gardner voting in favor.
TAX MATTER :
Robert Melling came into discuss taxes on property account #38676 in which his property was revalued in 1995 and his property taxes went from $300.00 to $2,200.00 a year. He expressed concern that neighbors across the street had placed their property in greenbelt even though it was for the same type of purpose and their taxes were less than $100.00. After listening to his presentation, Dennis Ayers explained that property values were consistent with other properties being sold in the area. Mr. Melling has applied for greenbelt in 1996. The County cannot make greenbelt applications retroactive.
Mr. Melling questioned what action the County could take. The Commission explained
that if the County made an error in his valuation and his valuation notice was sent to the wrong
address which did not allow an appeal at the regularly scheduled Board of Equalization
hearings, that the County would see what steps were necessary to convene a BOE to hear his
appeal. If the value of the property is correct as determined by the Assessor, then values and
tax rates cannot be changed.
LIVESTOCK TRAIL :
Mel Bulloch, along with Eddie Larson and Frank Nichols, came before the Commission to request that a livestock trail west of Cedar City which was designated in the General Plan be amended to reflect the actual route of the livestock trail. Concerns have been raised because adjacent property owners have started to fence this livestock trail. Tom Cardon made a motion to amend the map and place the trail on the correct line. Second was by Roy Urie with Robert Gardner voting in favor.
STEVE HEATH :
Steve Heath came to report on progress with the Old Sorrel trail marking project. The money has been raised to buy all of the plaques that will be installed at several spots along the Old Sorrel Trail. The project is scheduled to be completed during the summer of 1996 with several scout troops volunteering to do the work on constructing the monuments.
Mr. Heath requested that the County widen two spots on the Summit Mountain road to provide viewer parking for two markers. The Commission explained to Mr. Heath that before the spots could be widened, ownership would need to be determined and property owners contacted to see if additional right-of-way can be obtained.
Mr. Heath also outlined other projects that he would like to pursue in conjunction with the Utah Centennial. He reviewed some of the hardships that the first company of pioneer explorers led by Parley P. Pratt had encountered in 1849 as they came to Southern Utah to seek Iron ore. Mr. Heath has proposed that a monument be established at Exit 100 in northern Iron County, a second monument at the Parowan Gap, a third monument at Iron Springs and a fourth monument at the Kolob Canyon area commemorating this expedition. In conjunction with the marker at Iron Springs, Mr. Heath has proposed that the electric shovel used by Utah International at Iron Springs be moved to a site on property now owned by Iron County and that the monument be established in conjunction with an interpretive park around this shovel.
INTERLOCAL AGREEMENT :
An interlocal agreement between Cedar City and Iron County for maintenance of a road in Cedar Valley known as Second Lane West was approved on a motion by Tom Cardon, second by Roy Urie with Robert Gardner voting in favor. In exchange for the county maintaining a portion of the road within Cedar City limits, Cedar City would maintain the roads left in the unincorporated area left by their annexation.
After the bills were reviewed and either approved or rejected, the meeting was adjourned.
